Terms of Use

These Terms of Use (“Terms”) govern your use of the Mermaid World app and related services (together, the “Service”). “Mermaid World”, “we”, “us” and “our” refer to the operator of the Service. By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. You must be 18 or older

The Service is only for adults. By using it, you confirm that you are at least 18 years old, or the age of majority where you live if that is higher. If we learn that a user is under 18, we will close the account and delete its data.

2. Your account

When you first open the app, we create a guest account tied to your device, so you can try the Service without signing in. A guest account can be lost if you delete the app or change devices.
You can save your account by signing in with your email address (we send you a one-time code), with Google, or with Apple. If you sign in to an account you already have, the conversations from your guest account are moved into it.
You are responsible for what happens on your account and for keeping your email and sign-in accounts secure. Tell us right away at wohoodev@gmail.com if you think someone else has accessed your account.

3. AI characters

The characters in Mermaid World are fictional. Their replies are generated by artificial intelligence, not written by real people: you are always talking to an AI.
AI replies can be inaccurate, inconsistent, or unexpected. Do not rely on them for medical, mental health, legal, financial, or other professional advice.
The Service is not a crisis service. If you are thinking about harming yourself or someone else, or you are in danger, contact your local emergency services right away. In the United States, you can call or text 988 to reach the 988 Suicide & Crisis Lifeline.

4. Acceptable use

You agree not to:

use the Service if you are under 18;
create, request, or share content that is illegal, sexually explicit, sexualizes minors, promotes violence or self-harm, or harasses, threatens, or impersonates anyone;
try to get around the Service’s safety measures, usage limits, or account restrictions;
access the Service with bots, scrapers, or other automated means, or interfere with, overload, reverse engineer, or attack it;
create accounts in bulk, or sell, resell, or share access to the Service;
use the Service or its output to develop competing AI products.

We may decline to generate certain content, and we may suspend or close accounts that break these Terms.

5. Your content

“Your content” is what you write in the Service, such as your messages, your profile, and the personas you create. You keep whatever rights you have in it.
You give us permission to store, process, and transmit your content, including sending it to our AI model providers, as needed to run the Service, keep it safe, and comply with the law.
You are responsible for your content and must have the right to share it. Do not include other people’s personal information without their permission.
You may use the characters’ replies for your own personal, non-commercial purposes. Similar replies may be generated for other users.

6. Our content

The app, its characters, artwork, and design are owned by Mermaid World or its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the Service under these Terms. You may not copy, modify, distribute, or sell any part of the Service except as these Terms allow.

7. Paid features

Some features may require payment. Before you buy, we will show you the price and what you get. Purchases made through the App Store are processed by Apple and are subject to Apple’s terms, including its refund policies.

8. Changes to the Service and these Terms

We may change, suspend, or discontinue any part of the Service at any time, including its characters and AI models. We may also update these Terms. If a change is material, we will let you know in the app or by other reasonable means. If you keep using the Service after a change takes effect, you accept the updated Terms.

9. Ending your account

You can delete your account at any time in the app under Me › Settings › Delete account. This permanently deletes your account and conversations, as described in our Privacy Policy. We may suspend or close your account if you break these Terms, if we are required to by law, or if we stop offering the Service.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not promise that the Service will be uninterrupted, error-free, or secure, or that any content will be accurate.

11. Limitation of liability

To the fullest extent permitted by law, Mermaid World will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to the Service. Our total liability for any claim relating to the Service is limited to the greater of US$50 and the amount you paid us in the 12 months before the claim.

Some places do not allow these exclusions or limits, so some of them may not apply to you.

12. Apple App Store

If you downloaded the app from the Apple App Store:

These Terms are between you and Mermaid World, not Apple. Mermaid World, not Apple, is responsible for the app and its content.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. Apple has no other warranty obligation for the app.
Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims.
You must comply with applicable third-party terms when using the app, including the App Store Terms of Service.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
